The "Next Top Jewelry Designer" Contest ("Contest"), sponsored by Diamonds International ("Sponsor"), begins on October 1, 2007 and ends on May 31, 2008 ("Contest Period"). See Rule 4, below, for complete entry instructions.
The Contest is open to legal residents of the 50 United States and D.C. who are at least 18 years of age (19 years of age if a resident of Alabama or Nebraska). Professional jewelry designers or sellers are NOT eligible to participate. "Professional jewelry designer or seller" is defined, for these purposes, as including persons who are engaged primarily in the design or sale of jewelry, and who derive any income from such design or sale. Employees, officers and directors of Sponsor, its divisions, subsidiaries, and affiliates, and the advertising and promotion agencies of each of the foregoing, and any other entity that develops, produces, or distributes materials for or related to this Contest, and members of the immediate families (defined for these purposes as including parents, spouse, children, siblings, grandparents, and each of their respective spouses) or households (whether related or not) of any of the above are NOT eligible to enter or win. By participating in the Contest, entrants agree to be bound by these Official Rules, and by the decisions of the Sponsor, which are final in all matters relating to the Contest. The Contest is subject to all applicable federal, state and local laws and regulations, and is void outside the 50 United States/D.C. and where prohibited by law.
You must enter in one of the following categories: Category A - - "Student of Design". This category is open to all persons enrolled, at the time of entry, in an accredited design school on either a full-time or part-time basis, and all persons who have graduated from such a school within the six-month period immediately preceding the start date of this Contest. No entrant in this category may be a professional jewelry seller or designer as defined herein; or...
Category B - - "General Public". This category includes anyone other than those who qualify for entry as a "Student of Design (as defined above). No entrant in this category may be a professional jewelry seller or designer as defined herein.
In order to enter, you must first obtain an official Contest entry form by: (i) accessing www.ShopDI.com (search for keyword "Design") and downloading and printing out an entry form; or (ii) sending a request by email to service@ShopDI.com with the subject line "Design Contest"; or (iii) Sending a self-addressed, stamped #10 business-size envelope to DI Design Contest Entry Form, 38 West 48th St., Seventh Floor, New York, NY 10036 (VT residents omit return postage).
Next, sketch your original design for a ring, bracelet, earrings, pendant or necklace to be crafted in white or yellow gold only, that would sell, at retail, for approximately $1,000 or less. Your design may be intended for either a man or a woman, at your choice, and may include diamonds and/or genuine gemstones, at your choice. Your sketch must be at least 10" X 14" in size; non-conforming entries will not be accepted. Do not include any personally identifiable information on the front of your sketch.
Finally, mail your sketch (either your original sketch or a color copy of your original sketch), along with your fully completed official entry form, in an appropriate-size envelope to: DI Design Contest, 38 West 48th St., Seventh Floor, New York, NY 10036. All entries must be received by May 31, 2008. Please keep this date in mind when mailing your entry. You may wish to, but are not required to, submit your entry by overnight courier to ensure its timely receipt by Sponsor. Proof of mailing does not constitute evidence that we actually received it within the Contest Period. Limit one (1) entry per person for the entire Contest Period. Entries must be submitted by individuals only; no group entries allowed. Each entry may include one (1) sketch only. Be sure to clearly indicate on your entry form the category in which you wish to enter your submission. All incomplete or non-conforming entries will be disqualified.
By entering, each contestant represents that his/her submission is his or her original work; that neither the submission itself nor the act of preparing the submission infringes or infringed on the property or other rights of any third party; and that the submission has not been submitted in any other contest or won any award in any contest. Modifying, enhancing or altering a third party's preexisting work does not qualify as entrant's original creation.
All entries become the property of the Sponsor and will not be returned.
All eligible submissions in each category will be judged by a panel of qualified judges on or about June 1, 2008 based on the following criteria: originality (25%); beauty (25%); wearabilty (25%); quality of design (15%); sales potential (10%). In the event of a tie within either category, the entrant with the highest score in originality will be judged the winner. If a tie still remains, the entrant with the highest score in beauty will be deemed the winner. If ties remain, the tied entries will be re-judged on the same criteria. Entries will be judged against entries in the same category only. The one (1) top-scoring entrant in each category will be deemed a Grand Prize winner, and each will receive the appropriate prize as described in Rule 5, below. The next two (2) top scorers in each category shall be deemed Runners-Up and each will receive the appropriate prize as described in Rule 5, below.
Grand Prizes (One (1) per Category): The Grand Prize winning entry in each category will be created into finished jewelry (14k Gold) by Sponsor, and each winner will receive the finished jewelry as his/her Prize along with a $1,000 Diamonds International eGift Certificate. eGift Certificates are redeemable online only in accordance with all terms, conditions and polices of Sponsor. Approximate retail value ("ARV"): $2,000 per Grand Prize.
Runner-Up Prizes (Two (2) per Category): Each Runner-up will receive a $500 Diamonds International eGift Certificate. eGift Certificates are redeemable online only in accordance with all terms, conditions and polices of Sponsor. Retail value: $500 per Runner-Up prize.
Total ARV of all prizes in this Contest: $6,000.00.
Following confirmation of each winner's eligibility, the winners will be announced publicly and the winning submissions may be posted, at Sponsor's discretion, at www.ShopDI.com. All prizes consist only of items specified herein; all prize details not specified herein will be determined by Sponsor in its sole discretion. No transfer or substitution of prizes (or any portion thereof) or cash alternative permitted, except by Sponsor in the event the advertised prize is unavailable, in which case Sponsor reserves the right to substitute prizes of equal or greater monetary value. All income taxes on prizes are the sole responsibility of the winners. Each Grand Prize winner will be issued an IRS Form 1099 for the value of his/her prize. Sponsor is not responsible if prize is lost, stolen, damaged, and/or destroyed. All prizes will be awarded provided a sufficient quantity of qualifying entries is received, and prizes are claimed properly in accordance with these Rules.
By submitting an entry you warrant that it is your wholly original creation and does not infringe any copyright, trademark, or other proprietary right of any third party, union or guild. Submission of an entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify the entry in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without limitation and without notice or consideration to the entrant. By submitting an entry, each entrant in the Contest further acknowledges and agrees that his/her entry constitutes an assignment of all rights, title and interest in and to their submitted design to Sponsor, including but not limited to the right to manufacture, produce and/or sell entrant's submission or any derivative version thereof as finished jewelry, and absolute discretion alter the entrant's submission in any way, including without limitation the removal or addition of any element. Entrant further agrees that s/he will not be entitled to royalties or payment of any kind in the event Sponsor chooses to produce and sell his/her submitted design as finished jewelry. Sponsor may require Winners to execute documents to confirm this transfer of rights, or prize will be forfeited and an alternate winner selected based on the criteria stated herein.
By participating, entrants grant permission to Sponsor to use their names, likenesses, and biographical information for promotional or advertising purposes in all media worldwide, without limitation and without compensation or further notice unless prohibited by law. By participating, entrants hereby agree to release and hold harmless Sponsor, its affiliates, subsidiaries, each of their respective directors, officers, shareholders, employees, agents, advertising and promotional agencies, (collectively the "Releases") from and against any and all liability for loss, damage, harm, injury, cost or expense which may arise from or in connection with participation in this Contest (including but not limited to damage to entrants' or others' computer equipment resulting from downloading entry material), or their preparation for or participation in the Contest or preparation of any submission, or from their acceptance, possession use/misuse of a prize. BY accepting prizes, winners agree to indemnify and hold the Releases harmless from and against any claims, suits, losses, damages, and expenses, including reasonable attorney fees, which arise in connection with any allegation that their Submission violates the rights of any third party. Potential Winners will be notified by email, phone or postal mail by or about May 15, 2008, and will be required to execute and return an Affidavit of Eligibility and Release of Liability/ Publicity (where permitted) within ten days of first attempted written prize notification or they may be disqualified and alternate potential winners selected based on the criteria stated herein.
Sponsor is not responsible for: entries that are lost, late, stolen, incomplete, illegible, damaged, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures, destruction or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (iv) any entries submitted in a manner that is not expressly allowed under these rules; (v) incorrect or inaccurate entry information, or (vi) any typographical or other error in the printing or advertising of the offer, administration or execution of the Contest, or in the announcement of prizes/prize winners.
Except where prohibited, each participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate courts located in New York, and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of a different jurisdiction.
